A proposed Settlement has been reached in a class action lawsuit involving corrugated stainless steel tubing (“CSST”)Steel Tubing Sample manufactured by (1) Titeflex Corporation (“Titeflex”) sold as Gastite® and, (2) Ward Manufacturing, LLC (“Ward”) sold as Wardflex® (“Defendants”). The lawsuit claims that Defendants’ CSST is prone to perforation and possible gas leaks, fire, or explosion when energized by direct and indirect lightning strikes. Defendants deny these allegations and claim that CSST is not defective. There has been no determination of wrongdoing by the Court.

You may be included in the Settlement Class if you, as of March 15, 2017, own Property in the State of Maryland on which Titeflex’s Gastite® or Ward’s Wardflex® was installed after September 5, 2006 but before March 15, 2017, or you purchased Property after September 5, 2006 in which CSST was installed on or before September 5, 2006.

The Settlement provides a free safety inspection of your CSST, a discounted repair to bring the installation in compliance with code, if necessary, and a voucher to defray the cost of a Lightning Protection System. Eligibility for benefits is subject to other terms provided in the Settlement Agreement. The Settlement is contingent upon the Court’s final approval.

Your Legal Rights and Options in this Settlement

SUBMIT A CLAIM

This is the only way to receive benefits under the Settlement. You may open a claim by clicking here or calling 1-844-357-8798. The deadline to submit a claim is March 15, 2018.

EXCLUDE YOURSELF

You will not receive any benefits from the Settlement, but you will keep any rights you currently have to separately sue Defendants for the claims that are the subject of this lawsuit. The deadline to exclude yourself is May 15, 2017.

OBJECT TO THE SETTLEMENT

You may write to the Court explaining why you object to the Settlement. Any objection must be filed no later than May 15, 2017.

GO TO THE HEARING

If you do not exclude yourself, you may ask to speak in Court about the Settlement. The deadline to file a Notice of Intent to Appear is May 24, 2017. The Final Approval Hearing is scheduled for June 23, 2017 at 1:30 p.m.

DO NOTHING AT ALL

You do not have to submit a claim now. However, if you do not exclude yourself and do not submit a claim prior March 15, 2018, you will not receive benefits from the Settlement and you will give up any rights you currently have as specified in the Settlement Agreement to separately sue Defendants for the claims being resolved by the Settlement.
